The council has a legal duty under the Environmental Protection Act 1990 Section 149 to collect stray dogs and take them to a holding kennels, this is the only legal duty the Dog Wardens have to provide.

It is an offence under The Control of Dogs Order 1992 for a dog to be in a public place without a collar and an ID tag bearing the name and address of it’s owner. There are also several by laws within different councils requiring dog on leads and dog banned areas, these will be clearly signed and details of the by-laws are available from your local dog warden of request.

It is an offence under The Dog Fouling of Land Act 1996 for a dog walker not to remove their dogs faeces immediately from the land to which the public has access. The Dog Fouling of Land Act 1996 and all existing by-laws have been superseded by Part 6 of the Clean Neighbourhoods and Environmental Act 2005. However any designed areas under the legislation will remain effective until the council introduces new dog control orders, these orders are under review by the councils.
